What is the SBA 8(a) Business Development Program?

​The 8(a) BD program is one of several small business programs administered by the U.S. Small Business Administration (SBA) created to help small businesses gain access to the federal marketplace.  These small business programs also help the federal government achieve its small business and subcontracting goals (i.e 23% of all federal government contracting dollars to small businesses, and 5% to small disadvantaged businesses).

As hard as it may to believe, many businesses still underestimate the power of a well designed, informative website.  On the other hand, savvy businesses understand the importance of having a web presence, including having a visually appealing website with relevant content, relative to their ability to establish a solid reputation and market their business.  For example, how many times have you made instant judgments about a business based solely on its website, or lack thereof?  The reality is that we live in a digital era and federal contractors, although not always subject to traditional sales/marketing processes, are not exempt from the need to have a web presence.  With that being said, there are certain things/features that we would recommend federal contractor websites in particular should include.

SBA OHA's Recent Decision Clarifies Relevant Time for Determining Ostensible Subcontractor Affiliation & The Significance Of Knowing a Contract's Primary & Vital Requirements

On October 12, 2016, the SBA Office of Hearings & Appeals (OHA) issued a decision in the matter of:  Size Appeal of: Greener Construction Services, Inc.  This appeal arose out of the SBA's size determination which concluded that Greener Construction Services, Inc. ("Greener Construction") is affiliated with its subcontractor EnviroSolutions, Inc. ("ESI") under the ostensible subcontractor rule and is therefore not a small business under the applicable size standard.

Capability Statement:  What It Is And Why You Should Have One

Some of our readers may be wondering what a Capability Statement is, and I don't blame you.  I will openly admit that before I began working with government contractors, I would have wondered the same thing.  To put it simply, a Capability Statement is a company's resume.  More specifically, it is a 1-2 page document that clearly and succinctly describes (often in outline format) the company, its capabilities and its expertise.  More importantly, the Statement should differentiate the company from its competitors and identify why it is is the best company to be selected by the government to complete the task at issue.   If you are a government contractor, having a Capability Statement is a must.

We are often contacted by individuals and businesses that say they want to get into federal contracting, and the first question we ask is whether they have done their market research to find out if there is in fact a market within the federal space for the products or services they provide.  Many times, the answer we get is no and the response is generally accompanied by the question "is that something you guys can do for me?"  Market research is a critical first step whether you are operating in the commercial or federal market, and is a task that we recommend business owners do themselves, as it something that must be done on an ongoing basis.  To get you started, we are sharing some of the specific resources that we utilize when conducting market research.

These days, businesses are always in search of ways to operate more effectively and efficiently, which in turn generally results in increased productivity and profitability.  One strategy some companies use to increase their effectiveness and efficiency is to utilize outside contractors to outsource certain functions.  For some organizations, it does not make sense to have a full-time employee to do certain tasks in-house and it is more cost effective to utilize a company that specializes in that particular area.  Other businesses prefer the convenience of having someone else handle certain aspects of their daily operations.  There are also businesses that integrate and utilize outsourcing as a strategic part of their operation.

FAr Council Issues Final Rule Capping Employee Compensation

On September 30, 2016, the FAR Council finalized its Interim Rule which capped the allowable compensation for all contractor employees at the benchmark set by Congress in Section 702 of the Bipartisan Budget Act of 2013.  The Interim Rule has been in effect since June 24, 2014.   Under the Interim Rule and now the Final Rule, the cap on compensation remains at $487,000.  Note that compensation includes the total amount of wages, salary, bonuses, deferred compensation, and employer contributions to defined contribution pension plans.
