What Resources Are Available for Doing Federal Market Research?

We are often contacted by individuals and businesses that say they want to get into federal contracting, and the first question we ask is whether they have done their market research to find out if there is in fact a market within the federal space for the products or services they provide.  Many times, the answer we get is no and the response is generally accompanied by the question "is that something you guys can do for me?"  Market research is a critical first step whether you are operating in the commercial or federal market, and is a task that we recommend business owners do themselves, as it something that must be done on an ongoing basis.  To get you started, we are sharing some of the specific resources that we utilize when conducting market research.

These days, businesses are always in search of ways to operate more effectively and efficiently, which in turn generally results in increased productivity and profitability.  One strategy some companies use to increase their effectiveness and efficiency is to utilize outside contractors to outsource certain functions.  For some organizations, it does not make sense to have a full-time employee to do certain tasks in-house and it is more cost effective to utilize a company that specializes in that particular area.  Other businesses prefer the convenience of having someone else handle certain aspects of their daily operations.  There are also businesses that integrate and utilize outsourcing as a strategic part of their operation.

FAr Council Issues Final Rule Capping Employee Compensation

On September 30, 2016, the FAR Council finalized its Interim Rule which capped the allowable compensation for all contractor employees at the benchmark set by Congress in Section 702 of the Bipartisan Budget Act of 2013.  The Interim Rule has been in effect since June 24, 2014.   Under the Interim Rule and now the Final Rule, the cap on compensation remains at $487,000.  Note that compensation includes the total amount of wages, salary, bonuses, deferred compensation, and employer contributions to defined contribution pension plans.

Can Federal contractors utilize A professional employer organization (peo)?

One way of determining whether a business is small, for purposes of federal contracting and small business contracting programs, is by looking at the number of employees the business and its affiliates have.  In addition, questions regarding who a business'  employees are come up in the context of compliance with labor and employment laws/regulations.  We are frequently asked whether federal contractors can utilize a Professional Employer Organization (PEO) and if so, employees under a PEO arrangement are considered employees of the business.

paid sick leave regulations for federal contractors takes effect on January 1, 2017

 On September 7, 2015, President Obama signed Executive Order 13706, "Establishing Paid Sick Leave for Federal Contractors."  On September 30, 2016, the Department of Labor issued a Final Rule implementing the Executive Order on paid sick leave for federal contractors.  The Final Rule applies to covered prime contracts and subcontracts entered into on or after January 1, 2017.  Many of our clients have called with questions about the Final Rule, so the following provides some general information about it.

On September 30, 2016, the FAR Council published a Final Rule that immediately adopted, without change, the Interim Rule published on December 4, 2015 regarding a company's unpaid Federal tax liability or conviction of a felony criminal violation.   Specifically, the Final Rule created FAR 52.209-11 titled "Representation by Corporations Regarding Delinquent Tax Liability or a Felony Conviction under any Federal law and FAR 52.209-12 titled "Certification Regarding Tax Matters".
