On January 19, 2016, the SBA Office of Hearings and Appeals (OHA) issued a decision in the Matter of: Prosouth Construction Svcs, LLC. This appeal arose out of Prosouth's size protest against Birmingham Industrial Construction, LLC in conjunction with a construction procurement. In its protest, Prosouth, an unsuccessful offeror, alleged generally that Birmingham was not a small business under the applicable $15 million size standard and questioned whether Birmingham had the ability to self-perform at least 25% of the cost of contract performance, in accordance with the applicable limits on subcontracting. |

As a small business, we are painfully aware that running a small business is hard work. Between keeping track of customer/client complaints, monitoring and addressing employment/HR issues, maintaining internal productivity and keeping your team on track, it seems as though there just isn't enough time in the day to get everything done. Time is clearly important and therefore being efficient in use of time is also important. On February 9 - 10, 2016, the National 8(a) Association held its annual winter conference in Orlando, Florida at the Caribe Royale Hotel. As usual, the conference was well attended by representatives of both industry and government. Attendees were treated to informative general sessions, a wide variety of breakout sessions, and numerous opportunities to network with other businesses, consultants and government representatives. Unfortunately, the weather was not as warm as some of us may have liked, but it was still a great conference.
What is the HUBZone Program?
This Federal small business contracting program was created in 1997 to encourage economic development in HUBZones, which are areas that typically have low median household incomes and/or high unemployment rates. To identify HUBZone areas, use the SBA HUBZone map tool at http://map.sba.gov/hubzone/maps/. Currently, all neighbor islands are designated as HUBZone areas. On the island of Oahu, there are only small pockets of HUBZone designated areas. Government Goal: The Federal government’s goal is to award 3 percent of both prime and subcontracts to HUBZone firms. Unfortunately, this goal is one that the government consistently fails to achieve. Benefits: Similar to all of the other small business programs, benefits include set-aside and sole-source opportunities. Additionally, HUBZone firms enjoy a 10% price evaluation preference in full and open contract competitions, as well as subcontracting opportunities. The appeal, filed by GiaCare and Medtrust JV, LLC (an unsuccessful offeror) arose from a size determination which concluded that Global Dynamics, LLC (GDL) was not affiliated with its subcontractor, OMV Medical, Inc. (OMV) and was therefore a small business.
